user.cfg file banable?

Not sure if that work does exist. But I found that some people is using this file user.cfg on their Battlefield 3 directory just to get better fps(for those people who ussualy play on 30 fps max) so they get 50-60 fps. My question is: If I use this file is there a risk that I can get banned?
